RC Hypothecation Termination in India (2026): Removing a Loan From Your RC
If you bought a vehicle on finance, your RC carries a hypothecation entry naming the lender. Clearing the loan does not remove it. That is a separate step you have to take.
Until it is removed, you do not have clean title, and you cannot sell the vehicle without complications.
What hypothecation on an RC means
Hypothecation is the lender's security interest recorded against the vehicle. It appears on the RC as "hypothecated to" followed by the financier's name.
While it stands, the lender has a legal claim over the vehicle. You are the registered owner but you cannot transfer clean title, and a buyer's own financier will not lend against it.
Paying off the loan discharges the debt. It does not update the RC. The record stays exactly as it was until someone files to change it, and a surprising number of people discover this years later when trying to sell.
What you need before applying
The document that matters is the NOC from the financier.
The NOC and Form 35 typically have a validity period, often three months. Apply promptly after receiving them, because an expired NOC means going back to the lender for a fresh one.
- Form 35, signed by the financier. This is the formal notice of termination of hypothecation.
- No Objection Certificate from the lender, confirming the loan is cleared.
- Original RC.
- Valid insurance and PUC.
- Address and identity proof.
The process
Most states now handle this through Parivahan with a final RTO step.
Timelines vary by state, commonly a few weeks. The delay is usually at the financier end rather than the RTO: lenders are slow to issue NOCs and frequently need chasing.
- Obtain Form 35 and the NOC from the financier after the final payment clears.
- Apply for hypothecation termination on the Parivahan Vahan services portal, selecting your state and RTO.
- Upload the documents and pay the fee.
- Submit originals to the RTO where required.
- A fresh RC is issued without the hypothecation entry.
Why it matters before selling
This is where people get caught, and it is expensive.
A buyer cannot get finance on a hypothecated vehicle. A cash buyer takes on a vehicle whose RC names a lender, which most will not do. Transfer of ownership with hypothecation standing requires the financier's involvement, which they have no incentive to provide quickly on a loan already closed.
The practical consequence is a sale that stalls for weeks while you chase a bank for a document you should have obtained when the loan closed.
For a fleet disposing of vehicles at end of life, this compounds: every vehicle sold carries the same delay unless hypothecation was cleared at loan closure rather than at sale.
If the financier no longer exists
This happens with older vehicles and lenders that have merged or wound up.
Where the lender has merged, the acquiring institution issues the NOC. Where it has genuinely ceased to exist, the RTO has a procedure involving public notice and an affidavit, which is slower and needs to be started well before any planned sale.
Either way, do not assume an old loan simply lapses. The entry stays on the record indefinitely.
Frequently asked questions
What is hypothecation on an RC?
It is the lender's security interest recorded against the vehicle, shown on the RC as hypothecated to the financier. While it stands you cannot transfer clean title, and a buyer's financier will not lend against the vehicle.
Does hypothecation get removed automatically after the loan is paid?
No. Paying off the loan discharges the debt but does not update the RC. Termination is a separate application, and the entry stays on the record until someone files to remove it.
What documents are needed for hypothecation termination?
Form 35 signed by the financier, the No Objection Certificate from the lender, the original RC, valid insurance and PUC, and identity and address proof. The NOC and Form 35 often carry a validity of around three months, so apply promptly.
How long does hypothecation termination take?
Commonly a few weeks, varying by state. The delay is usually at the financier end rather than the RTO, since lenders are frequently slow to issue the NOC and need chasing.
Can I sell a vehicle with hypothecation still on the RC?
It is possible but difficult. A buyer cannot obtain finance on it, most cash buyers will refuse, and transfer requires the financier's involvement in a loan they have already closed. Clearing hypothecation at loan closure rather than at sale avoids weeks of delay.
